Beispiel: Hat der Makler f\u00e4lschlicherweise eine Gartenbenutzung zugesagt oder die Lage der Immobilie in einem Hochwassergebiet verschwiegen, so kann der Auftraggeber eine M\u00e4\u00dfigung der Provision verlangen.<\/p>\r\n\r\n\r\n\r\n<p>Zu den Pflichten z\u00e4hlen u.a. auch besondere Aufkl\u00e4rungspflichten nach dem Konsumentenschutzgesetz. Auch wenn der Immobilienmakler mehr als die gesetzlich geregelte Provisionsh\u00f6chstgrenze oder mehr als die vereinbarte Provision verlangt, muss er mit einer R\u00fcckforderung des zu viel gezahlten Teils der Provision rechnen. Diese R\u00fcckforderung muss vom betroffenen Kunden in der Regel innerhalb von drei Jahren gerichtlich eingeklagt werden.\u00a0Hat der Makler seinen Kunden nicht rechtzeitig (so rasch wie m\u00f6glich bzw. vor Abschluss des Maklervertrags) schriftlich \u00fcber ein famili\u00e4res bzw. wirtschaftliches Naheverh\u00e4ltnis zum Auftraggeber informiert, so verf\u00e4llt der Anspruch auf Provision.
